The Deprivation of Liberty Safeguards (DoLS)

The Deprivation of Liberty Safeguards (DoLS) were introduced in 2009 and are a part of the Mental Capacity Act (2005). 

They were introduced to prevent breaches to the European Convention on Human Rights (ECHR), and specifically Article 5 of the ECHR which states that:

  • Everyone has the right to liberty and security of person
  • No-one shall be deprived of his liberty save in the following cases and in accordance with a procedure prescribed by law: (e) the lawful detention of persons of unsound mind.
  • Everyone who is deprived of their liberty by arrest or detention shall be entitled to take proceedings by which the lawfulness of his detention shall be decided speedily by a court and his release ordered if the detention is not legal.

The safeguards therefore provide legal protection for vulnerable people in care homes or hospitals who are, or may become deprived of their liberty.
